OLSON GRIMSLEY CELEBRATES TWO YEARS

Olson Grimsley Kawanabe Hinchcliff & Murray LLC is an impact litigation firm founded in the fall of 2023 with the mission of holding the powerful to account.

In our first 2 years, we handled seven trials to judgment and four appeals, achieving more than $80 million for our clients. Over a third of our work has been pro bono. We brought the Colorado ballot access case against Donald Trump to the U.S. Supreme Court and are suing to stop warrantless arrests of immigrants. We won the first preterm infant formula necrotizing enterocolitis case tried in the country, and are about to go to trial again. There doesn’t need to be daylight between doing good and being successful.

In 2025, we added three associates:

Bianca Miyata served as Senior Assistant Attorney General in the Consumer Fraud Unit of the CO Attorney General’s Office.

Meredith Wheeler is a Rhodes Scholar who finished her Ninth Circuit clerkship after serving as a CO Public Defender.

Noah Nix completed his clerkships at the Tenth Circuit and Colorado Supreme Court.

SOME HIGHLIGHTS FROM OUR SECOND YEAR

Standing Up for Student Athletes


OG partnered with Korein Tillery to represent 300+ former college athletes who opted out of the NCAA settlement. Our clients allege the NCAA and Power 5 Conferences violated antitrust laws, and their individual claims will now proceed in federal court in Colorado.

Obtaining Justice for Terrorism and Human-Trafficking Victims


OG and Sparacino PLLC represent hundreds of victims of overseas terrorism and human trafficking in two federal cases. After OG’s oral argument, the court allowed key claims to proceed, confirming the TVPRA applies to ventures with conduct abroad.

Fighting for Tenants


OG partnered with Towards Justice, Edelson, and Cadiz Law to represent tenants challenging Greystar—the nation’s largest apartment manager—for charging illegal “junk fees” that inflate housing costs. After OG’s argument, the Colorado Supreme Court consolidated the cases before the district judge OG requested.

OG was also set to argue Curran v. Home Partners Holdings before the Colorado Supreme Court when the case settled days prior. We represented tenants who alleged that lease terms with a Blackstone subsidiary violated the warranty of habitability and the Colorado Consumer Protection Act.

PRO BONO CAUSES

Defending Transgender Policy


A national religious advocacy group sued Jefferson County Public Schools over its policy for transgender students, particularly room assignments on overnight trips. OG secured a complete victory for Jeffco, with all claims dismissed, upholding its commitment to a safe and inclusive learning environment.

Gun Safety


OG represented Everytown for Gun Safety, Giffords Law Center, and other advocacy groups and academics in a merits-stage amicus brief before the U.S. Supreme Court in Smith & Wesson Brands, Inc. v. Estados Unidos Mexicanos. The brief urged the Court to narrowly resolve the second question presented under the Protection of Lawful Commerce in Arms Act—and the Court’s opinion followed that approach.

Protecting Immigrants


OG, alongside ACLU Colorado and Meyer Law, brought a class action against the Trump Administration challenging mass warrantless ICE arrests that violated federal law. The suit emphasizes that federal law protects everyone—regardless of race, language, or neighborhood—by requiring individualized determinations before arrest. OG led that PI hearing at the end of October, and await a ruling from the Court.

Law Firm Partners United


OG represents Law Firm Partners United Inc. (LFPU), an association of 850+ AmLaw 200 partners and shareholders dedicated to defending lawyers’ constitutional right to choose their clients and advocate without government reprisal. LFPU retained OG and Zimmer, Citron & Clarke to file amicus briefs challenging Executive Orders targeting law firms.

WHAT’S ON THE HORIZON

Defending Enfamil Mass Tort


OG serves as lead appellate counsel before the Illinois Court of Appeals, seeking to uphold a $60 million verdict against Mead Johnson, maker of Enfamil Premature Infant Formula. The Illinois jury found the cow’s-milk formula caused necrotizing enterocolitis in premature infants—the first trial of its kind nationwide. OG led trial efforts with Keller Postman and The Cates Law Firm.

Leading Similac Product Liability Trial


OG is lead trial counsel in a consolidated four-plaintiff case against Abbott Laboratories, maker of Similac Special Care preterm formula, alleging it caused necrotizing enterocolitis in premature infants. This will be the first multi-plaintiff preterm infant formula trial in the nation and the first in Cook County, Illinois. OG is working with Keller Postman; Abbott is represented by three AmLaw 100 firms.

Antitrust Class Action


OG and Freed Kanner London & Millen filed a class-action antitrust suit alleging that major archery retailers, manufacturers, and trade associations conspired to fix product prices. OG won its argument to have the Judicial Panel on Multidistrict Litigation locate the MDL in Colorado—the first in Colorado federal court in more than 15 years.
